Wednesday night collision happened along S. Chestnut Drive
LUFKIN, TX, (November 06, 2024) - A late-night accident on S. Chestnut Drive left two people injured after their vehicle struck a deer and crashed into a pole and guardrail. The incident occurred shortly before midnight on Wednesday, according to a report from the Lufkin Police Department.
Lisette Aguilar was seriously injured on Wednesday when the vehicle she was a passenger in crashed in Lufkin.
Adrian Alexander Garcia Martinez, a 24-year-old resident of Lufkin, was driving a 2008 Ford F-150 pickup truck south when he reportedly struck a deer, causing him to lose control of the vehicle. The truck veered off the road, crashing into a pole and guardrail, the report stated.
Martinez was transported to St. Luke’s Health-Memorial for treatment of a suspected minor injury before being taken to the Angelina County Jail on charges of driving while intoxicated.
His passenger, 22-year-old Lisette Aguilar, sustained serious injuries and was taken to Memorial for treatment after being trapped in the vehicle due to the major damage caused by the crash.
According to the report, Martinez told officers that he struck the deer, which led to the loss of control. The investigating officer listed failure to control speed and suspected alcohol consumption as contributing factors to the accident.
The Lufkin Police Department continues to investigate the crash.
DUI ACCIDENT INVESTIGATION
This accident was clearly preventable. Impaired drivers are a risk to everyone on the road, and can senselessly ruin people's lives.
"Drunken and drugged drivers are subject to criminal charges following an accident or collision that causes harm or kills another person,’’ explained Candice Bond, a Managing Partner at Bond Legal.
She added, “Separate from criminal charges, the family of a victim may be entitled to compensation through a civil lawsuit against the responsible party.”
According to the National Safety Council, the cause of 10 percent of all fatal automobile accidents is drivers operating vehicles under the influence of alcohol, drugs, or other medications. These accidents are the second-leading cause of automobile fatalities in this country.
PERSONAL INJURY CLAIM
Lisette Aguilar may have the right to pursue a personal injury claim pending an investigation.
Bond said, “Injured victims involved in a collision often seek a personal injury claim to cover the cost of medical bills, future medical care, loss of income, emotional trauma, and pain and suffering.
"Insurance companies can be notoriously unconcerned with the mounting costs that an injured party may accrue. An attorney can help. We protect the victims of these tragedies daily, forcing the insurance companies to pay for their mistakes,” she added.
