Police investigating Tuesday night accident along Ernest Barrett Parkway

MARIETTA, GA, (November 05, 2024) - The Cobb County Police Department says a Tuesday night vehicle vs. pedestrian accident in Marietta left a woman hospitalized with severe injuries.

Pedestrian AccidentA pedestrian was seriously injured Tuesday night when she was struck by a vehicle driven by Christine Moore along Ernest Barrett Parkway in Marietta.

According to authorities, Powder Springs resident Christine Moore was driving a 2019 Mitsubishi Mirage along Ernest Barrett Parkway when she struck a pedestrian crossing the street near Stilesboro Road around 8:31 p.m.

The victim sustained critical injuries and was rushed to Wellstar Kennestone Hospital for treatment.

An investigation into the incident is underway.

PEDESTRIAN ACCIDENT INVESTIGATION

Vulnerable road users like pedestrians face danger every day. While all of us are advised to be careful, the burden of responsibility falls on people driving or riding in vehicles.

According to the Centers for Disease Control and Prevention (CDC), an estimated 104,000 pedestrians were injured in crashes and transported to local emergency rooms in 2020. These crashes are often caused by factors such as distracted driving, speeding, and failing to yield to a pedestrian.

“Having the proper resources is extremely important in order to investigate a pedestrian accident case and prove negligence,” said Candice Bond, an experienced pedestrian accident attorney and a Managing Partner with Bond Legal.

Bond stressed: “In most instances, pedestrians possess the right of way when crossing an intersection or a street regardless of if they are in a marked crosswalk. It is always a driver’s duty to yield to any pedestrian.”

PERSONAL INJURY CLAIM

The victim may have the right to pursue a personal injury claim pending an investigation.

Bond, a national legal analyst for Newsline, said, “It is vital for victims to hire an attorney when filing a personal injury claim, which allows them to negotiate with an insurance company on behalf of a client.”

“Insurance companies often try to pressure victims to settle for a quick payout for far less than the case is worth. However, she added that an attorney will vigorously advocate for their client to ensure they are treated with respect and compensated fairly.”
